These Terms and Conditions ("Terms") govern your access to and use of the Eligify mobile and web application, including all features, services, and content. By registering an account or using any part of our service, you agree to be bound by these Terms. If you do not agree, please do not use our service.

1. Acceptance of Terms

By creating an account, filling the eligibility form, or making a payment, you confirm that you are at least 16 years old and have the legal capacity to enter into a binding agreement.
If you are using Eligify on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
These Terms apply to all users — students, parents, guardians, and any other visitors of the platform.

2. Account Registration and Security

2.1 Creating Your Account

You must provide accurate, complete, and current information during registration.
Account access is secured via OTP (One-Time Password) sent to your registered email — no password is required or stored.
You must notify us immediately at support@eligify.com if you suspect unauthorised access to your account.
One person may maintain only one account. Duplicate accounts may be suspended.

2.2 Account Termination

Eligify reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
You may delete your account at any time through app settings or by contacting our support team.

3. Description of Services

Eligify offers the following services to registered users:

4. Eligibility Check — Free Service

The eligibility check and university listing are provided free of charge to all registered users.
Results are generated based on the information you provide. Eligify does not guarantee admission to any institution.
University availability and eligibility criteria may change without notice.
The free listing is for informational purposes only and does not constitute a formal application or offer of admission.

5. Paid Application Service

5.1 Fees and Payment

A service fee is charged to submit applications on your behalf. The fee is determined based on current market rates and the number or type of universities selected.
All fees are displayed clearly before payment. You must authorise payment before any application is submitted.
Payments are processed securely through our trusted third-party payment gateway.
All prices are inclusive of applicable taxes unless stated otherwise.

5.2 Refund Policy

Fees are non-refundable once an application has been submitted to a university.
If Eligify is unable to submit your application due to a technical error on our part, a full refund will be issued within 7 business days.
Refund requests must be submitted within 14 days of the transaction date.
Refunds will be credited to the original payment method used.

5.3 What Is Included

Submission of your application to selected universities via email or official portals.
Monitoring for university responses and forwarding them to you promptly.
Guidance on next steps (document submission, interviews, offer acceptance) where applicable.
Communication with the institution on your behalf as agreed at the time of purchase.

Important: Eligify acts as a facilitating agent only. We do NOT guarantee an offer of admission. Admission decisions are made solely by the respective universities based on their own criteria and policies.

6. University Communication and Notifications

When a university replies to your application, Eligify will notify you via email and in-app notification within 24 hours of receiving the response.
Eligify will share the university's response with you in full and advise on recommended next steps.
Where further action is required (e.g., document upload, visa guidance), Eligify will continue to liaise with the institution on your behalf.
All communications between Eligify and universities are conducted professionally and accurately represent the information you have provided.
You authorise Eligify to communicate with universities on your behalf upon payment of the service fee.

7. User Responsibilities

By using Eligify, you agree to:

Provide accurate and truthful information in all forms and documents. Providing false information may result in rejection by universities and termination of your Eligify account.
Keep your registered email account secure and not share OTP codes with others.
Not use Eligify for any unlawful purpose or in violation of these Terms.
Not attempt to hack, disrupt, or reverse-engineer the Eligify platform.
Cooperate with Eligify by providing requested documents or information in a timely manner.
Promptly inform Eligify of any changes to your profile that may affect your application.

8. Intellectual Property

All content on Eligify — including the logo, design, text, algorithms, and university matching logic — is the exclusive intellectual property of Eligify.
You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes only.
You may not copy, reproduce, distribute, or create derivative works from any Eligify content without prior written consent.

9. Disclaimer of Warranties

Eligify is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:

Guarantees of admission to any university.
Uninterrupted or error-free operation of the application.
Accuracy or completeness of university information and eligibility results.
Fitness for a particular purpose.

10. Limitation of Liability

Eligify shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
Our total liability to you shall not exceed the amount you paid for the specific service giving rise to the claim.
We are not responsible for decisions made by universities regarding your application.
We are not liable for delays caused by third parties, including payment processors or university portals.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising from these Terms or your use of Eligify shall first be attempted to be resolved through good-faith negotiation.
If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of India.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When changes are made, we will update the Last Updated date and notify you via email or in-app notification. Your continued use of Eligify after such changes constitutes acceptance of the new Terms.
